Job Discrimination: Types of Discrimination in the Workplace

Now more than ever, it is important to be aware of your rights as an employee. We are returning to work at a time when workers and employers are unsure of where they stand in the post-pandemic era.

Meanwhile, a tight labor market means that some employers are resorting to harmful practices to keep staff working longer. For these reasons and more, job discrimination cases are rising fast.

If you feel that you have been a victim of workplace discrimination, you must take action quickly to protect yourself and secure any compensation you might be entitled to. With that in mind, these are the main types of job discrimination to be aware of today.

Gender Discrimination

This is one of the most common forms of workplace discrimination in America, and it comes in many forms.

Gender discrimination often surfaces as a gender pay gap, with male employees often paid more than female employees for the same role. Another common form of gender discrimination concerns flexible working.

If your employer refuses to accommodate your flexible working request due to, say, childcare needs, they might be on the wrong side of the law. Always consult a flexible working legal expert if you feel you have been subjected to this form of discrimination.

Disability Discrimination

Under the Americans with Disabilities Act (ADA), all disabled employees have legal protections against discrimination. Your employer must make reasonable accommodations in your workplace so that you can do your job.

Your employer must also ensure that your coworkers and customers do not discriminate against you. If you have a disability, you should act fast and lawyer up if you suspect discrimination.

Race Discrimination

Under the Civil Rights Act, all racial discrimination in the workplace is illegal. Almost every country has similar legal protections.

If you are discriminated against for your race, skin color, nationality, or perceived race, you are protected by this law. This includes any discrimination that you think has happened during the hiring process, even if you did not get the job.

Age Discrimination

Senior citizens are a protected class in America and most countries around the world. If you feel discriminated against because of your age, you might be entitled to damages.

If you think you have been discriminated against because of how young you are, the same applies. As America ages, we must take a robust stand against age discrimination.

Sexuality Discrimination

Discrimination based on sexuality is getting more attention, as more Americans identify as LGBTQ+. While this was once a gray area, that is no longer the case.

The Supreme Court recently ruled that LGBTQ+ people have protection under the Civil Rights Act. This means discrimination based on sexuality or gender identity is a federal crime. If you think this has happened to you, take action now.
